Unlike assisted living communities, independent living communities in Mississippi aren’t licensed or regulated through the Mississippi State Department of Health. This is because independent living communities don’t provide caregiver assistance for things like bathing or dressing. About half of our partner independent living communities do offer assisted living, or assisted living and memory care, on the same campus. In these cases, those parts of the community do need a license.
Seniors in an independent living apartment can expect the following services without the community requiring a license:[01]
New residents will sign a lease or a contract with the community. This is similar to what you’d sign for an apartment, and you can expect to have the same renter’s rights. Look to the Landlord-Tenant Act for more details.
Since independent living caters to senior tenants, many communities are designed with accessibility features in mind. In Mississippi, you can expect an independent living community to follow these guidelines in accordance with the Americans with Disabilities Act:[02]
Independent living communities and other senior housing are able to cater to a senior audience through an exemption in the Fair Housing Act. The community must either be occupied only by people 62+ or have a tenant who is over 55 in 80% of the units.[02] For more information about ADA compliance features, refer to Mississippi’s fair housing and equal opportunity policy and procedures.
