Medicaid

Medicaid doesn’t cover rent for senior apartments, but it can be used toward some applicable in-home health care costs.

Medicaid in Florida is operated by the Agency for Health Care Administration through the Statewide Medicaid Managed Care program (SMMC). This program is divided into three components: the Long-Term Care program, the Managed Medical Assistance program, and the Dental Program.

The Long-Term Care program, which aims to prolong independent living by funding in-home health services, will be the most applicable to Individuals living in senior apartments. Seniors can apply for the program through a Long-Term Care waiver and view the enrollment steps here.

People who want to use Medicaid to help with other health care costs can also apply through the Home and Community-Based Services Waiver program. In Florida, Medicaid covers in-home health care services conducted by a registered nurse, licensed practical nurse, or qualified home health aid.

Medicare

Seniors who are 65 years of age or older or individuals who are diagnosed with certain illnesses and disabilities can apply for Medicare, a federal health insurance program. Like Medicaid, Medicare doesn’t cover rent. However, seniors can use it to pay for necessary in-home care.  Typically, these costs are for short-term acute care, doctor visits, and medication. There are also several state and local programs that can support expenses and questions related to Medicare. These programs include:

  • Florida Medicare Savings Program. This program supports those on low fixed incomes by paying for Part A and Part B premiums. You can check online to determine eligibility and enroll.
  • Florida Discount Drug Card Program. All Floridians can use this drug card program to receive discounts on most prescription medications.
  • Serving Health Insurance Needs of Elders (SHINE). SHINE offers free financial Medicare counseling and virtual Medicare classes.
  • Hope Program for All-Inclusive Care of the Elderly (PACE). The Hope PACE program provides free services like medical care, home care, and diagnostic services for eligible seniors. To determine eligibility and enroll, check the PACE website.

Public assistance for seniors in Naples

People on a low income may find assistance through the Housing Choice Voucher program managed by the U.S. Department of Housing and Urban Development. This program helps cover some monthly rent costs and can be used in any accommodation where housing choice vouchers are accepted. You can determine eligibility on the HUD website.

Understand Florida laws and regulations for senior apartments communities

As rental properties, senior apartments are subject to all state and federal laws that apply to rental housing. Locally, Collier County enforces the Fair Housing Act, which protects people from discrimination during the sale, rental, or financing of housing. It also ensures that those with disabilities aren’t discriminated against when receiving federal financial assistance.[03]

Renters are also protected by the Americans with Disabilities Act which makes it unlawful to discriminate against people with disabilities. It also ensures those with disabilities can request reasonable accommodations for rental properties. In addition, the Equal Credit Opportunity Act provides protection from discrimination during any part of a credit application.[04]

Additionally, Florida has local tenants’ rights, laws, and protections, all of which can be accessed on the U.S. Department of Housing and Urban Development website. According to Collier County regulations, all condos or co-op buildings three stories or taller must have structural inspections once they are 25 years old and every ten years after that. Inspection reports are available online.

Senior apartments also have age restrictions in Florida. At least 80% of occupied units must have a resident over 55 years of age, while other occupants must not be younger than the minimum age requirement. This requirement changes from community to community, but it is typically 45.
